Looks like it’s a little more complicated. It is illegal, but they’re doing it anyways before the courts rule on an explicit rule being broken. Their excuse isn’t very good either, so it’d be a pretty transparent loss of faith in the courts to authorize it. Probably just making them to give their buddies to show off what they can get away with.
